Prop 37 Passed: What It Means for Irvine Home Buyers
By Alvin Wang, W Global Estate — Alvin Wang Group (eXp Realty, DRE #01883462) ·
What Is Proposition 37 and Did It Pass?
Quick answer: Yes. California voters approved Proposition 37 on November 3, 2026. It lets the California Housing Finance Agency (CalHFA) sell up to $25 billion in revenue bonds for a "middle-class homeownership loan" that can cover up to 17% of the price of a qualifying newly built home. Buyers still put at least 3% down, and the program is not open yet.
The Associated Press projected Prop 37 as passing on election night, KQED reported. In the statewide count posted Wednesday evening, November 4, Yes had 4,783,474 votes (61.2%) to 3,036,774 for No (38.8%), according to The Ballot Book. Orange County voters also backed it, 55.9% Yes as of the county's 5:46 p.m. update. These are still unofficial results until the state certifies the election.
As an Irvine-focused team, W Global Estate — Alvin Wang Group (eXp Realty, DRE #01883462) takes no side on ballot measures. We are covering Prop 37 because it is a rare statewide change aimed squarely at down payments, which is often the biggest hurdle for Irvine buyers.
How Will the Prop 37 Down Payment Loan Work?
According to the Legislative Analyst's Office (LAO), each middle-class homeownership loan can cover up to 17% of the home price, and the buyer must put down at least 3%. Together that reaches 20% of the price, with a regular first mortgage covering the rest. CalMatters gives a simple example: on an $800,000 home, the buyer's cash down payment would be $24,000.
It is a loan, not a grant. Homeowners repay it with monthly payments, and those payments repay the bond investors and cover program costs. The LAO says CalHFA must keep interest costs for homebuyers as low as possible, and it estimates no direct cost to state or local governments. A mortgage broker interviewed by KCRA noted that buyers would have two loan payments, but that reaching 20% down could help some buyers avoid private mortgage insurance.
Who Qualifies for a Prop 37 Loan?
Not every buyer or every home will qualify. Based on the LAO analysis, the official ballot label, and KCRA's reporting, the main rules are:
- Income: household income can be no more than double the typical (median) income for the area.
- Residency and occupancy: buyers must be California residents (KCRA reports at least one year) and must live in the home as their primary residence.
- New homes only: the buyer must be the first purchaser of a newly built home, or of certain converted nonresidential buildings sold for the first time. Resale homes do not qualify.
- Price limits: the ballot label describes eligible homes as priced below about $1.5 million, and The Irvine Times notes that price limits can vary by county and be adjusted over time.
- Down payment: the buyer must contribute at least 3% of the purchase price.
What Does Prop 37 Mean for Irvine Buyers?
Because Prop 37 is limited to newly built homes, Irvine's new-construction pipeline matters. OC Development reports that the Irvine Business Complex (IBC) alone had about 11,280 homes as of April, with about 1,870 more under construction and 542 approved. KB Home's 108 for-sale townhomes at 16842 Von Karman Avenue, which we covered at wglobalestate.com/blog/kb-home-irvine-business-complex-townhomes-2026, are the kind of newly built homes the program is aimed at.
Longer term, the city is planning about 1,150 homes at the Crescent site near Irvine Station (see wglobalestate.com/blog/irvine-crescent-site-transit-village-plan-2026), and the Great Park area continues to grow (see wglobalestate.com/blog/irvine-great-park-development-update-canopy-2026). If you are watching builder releases in newer villages such as Great Park Neighborhoods or Portola Springs, ask the builder whether homes are expected to be eligible once the rules are out. Whether any specific Irvine community qualifies will depend on the price limits and rules CalHFA sets for Orange County.
For buyers, the practical takeaway is to start preparing now: check your household income against local limits once they are published, keep your credit strong, and save at least 3% plus closing costs. Then compare a Prop 37 loan with existing CalHFA programs and conventional loans when it launches. To explore Irvine's villages, see our neighborhood guide at wglobalestate.com/areas/irvine.
Does Prop 37 Affect Irvine Home Sellers?
Not directly. Because the loan requires the buyer to be the first purchaser of a newly built home, owners selling existing Irvine homes cannot offer it to their buyers. Sellers should still watch it: if the program launches at scale, some first-time buyers may choose a qualifying new townhome or condo over a resale home in a similar price range. The LAO says the program's reach will depend on investor demand for the bonds, how its loans compare with other options, and whether it leads to more home building. What About Proposition 1?
Voters also approved Proposition 1, an $11.25 billion general obligation bond, the Los Angeles Times and KQED report. Most of it goes toward building and renovating affordable housing, including about $5 billion for the state's Multifamily Housing Program, plus $1.25 billion for the CalVet Home Loan program for veterans. The LA Times reports that the University of California and California State University will split $350 million for student housing. The LAO estimates repaying Prop 1 will cost the state $500 million to $600 million a year for about 25 years.
When Can Irvine Buyers Apply?
Not yet. KQED reports that Prop 37 could take a little longer to implement, because CalHFA must first create the new program, and qualifying homes have to be built before anyone can buy them. CalHFA will also decide how much of the $25 billion to issue and over what period. We will update this post when CalHFA publishes program details, income limits, and Orange County price limits.
